I have decided on a whimsical name for my new website. I am calling it McDonaldz.com. It is an online shopping site. If there is any company or product with a similar name, say in the food industry, I’m sure they won’t mind.
This seems to be the thinking of two women who started a company called Milkdudz. They make clothing (duds) for nursing mothers (thus the milk reference). These women were shocked (and, it seems outraged) that Hershey would want to protect its trademark Milk Duds. How could Hershey think there will be any confusion since one is candy and the other is clothing? they ask.
My guess is they had prior knowledge of the candy and that is, in part, why they chose the name. The name Milkdudz resonates with all of us because of our childhood association with the candy. Hershey has spent a lot of money building goodwill in the name and needs to protect its mark.
Even if there can be no confusion due to the different products, Hershey must protect its trademarks. Guess what. Hershey is suing Milkdudz.
As Revenews readers know, I am a big proponent of companies protecting their trademarks and will keep an eye on this story.
Of course, the press may mean success for Milkdudz or whatever it is called in the future. The company’s website has gone from a 3 month Alexa ranking of 1,371,803 to an Alexa ranking of 21,256 today.
