And it burns, burns, burns…

April 5th, 2006 by Chris Boyd

….sorry if you expected something about Johnny Bandwagon (sorry, Cash) here, but that extract seemed appropriate given the subject. There’s a rather large ring of fire in the distance, and it seems to be hovering over the New York area. The man that lit the fuse is Eliot Spitzer, The Attorney General of New York. The target? Direct Revenue. That’s right - my special friends.

Now, from what I’ve seen, Eliot’s method involves

a) targetting a company then
b) dropping a media-neutron bomb on their heads, no doubt with “Death from above” scrawled on the side.

Just as well then, that the documentation in this case is the real eye-opener - especially the Email extracts. I covered some of it here, but needless to say, when you’re hiring private investigators to put the frighteners on critics, you really have to question where things are going wrong.

And how many ad-type guys here have a department called “Dark Arts”? Is this online advertising we’re talking about here, or the next Harry Potter movie? Best of all is the inevitable response on the Direct Revenue website. Yep, it’s a bit of a dead duck. Basically, it’s the old excuse - hey, we’re clean now, just because we trampled on everybody on the way up x amount of months / years ago means nothing!

Well thanks, I’m sure that’ll go down well with the masses baying for some form of justice over countless PCs hijacked and trashed by the many, many, many, many, many, many, many rogue installs we’ve seen in the past. The stubborn refusal to admit any wrondoing in the past is only matched by the sheer arrogance displayed in many of the emails cited in the complaint document. I get the impression of one or two lone, sane voices in a crowd of people too caught up in the thrill of hardcore money-making to really care about how many PCs were trashed on a day to day basis. I’m not quoting any of them on purpose, because I really want you to read the full PDF.

Maybe we should just forgive and forget. Accept that networks have cleaned up and “got with it”. However - I can’t, and won’t. Someone needs to be held acountable for their actions in all things, and if you screw up, you gotta’ roll with it. As noted over at the Sunbelt Blog, one of the VC partners said, “At least we’re not Ebola”.

Well, I eat Ebola for breakfast.

Hopefully, Spitzer does too.

Right on! Keep applying pressure. Let’s drive adware off the shore. Which is where this is all going. Claria, 180, WhenU, and Direct Revenue are all running from their pasts. They will be so absorbed in legal battles that their adware business will suffer. leaving room unfortunately on the desk top for CWS and their ilk.

I think affiliate managers and media buyers need to read the whole 57 pager by Justin.

Print it out.
Get a yellow felt tip pen and start highlighting names.

Then go to your partner list. I think you might be surprised. Some surprised me, except the part about bearing down on anti-spyware researchers of course.

Thanks Chris :)
Yep, Iv’e also read all 57 pages twice and a few things shocked even ME so ditto to Professor Porter.

I would only say, the Justin document is REQUIRED reading for ALL. Even those of you who pleade in a respectfull fashion that you play in the Spyware space because all your competitiors due and thus you use the “prisoner” arguement which in another sence, I wish was true for all convicted infectors but it’s a civil action.

Finally, in my view it’s reasonable to assume (?) that an “insider” at DR handed over all those juicy emails to Spitzer and crew. The nails in the coffin if you will. Look around, you Spyware lovers probably either have a conflicted employee or one who doesn’t like management and can’t wait to inhale deeply and then blow the whistle.
